These Terms and Conditions (“Terms”) govern your access to and use of podbenchmark.com and its product search, comparison, profitability, and related features (the “Service”). POD Benchmark operates the Service.
By using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
If you use the Service on behalf of a company or another organisation, you confirm that you have authority to bind that organisation to these Terms.
1. The Service
POD Benchmark is an informational comparison service for print-on-demand products and suppliers.
The Service may display:
- product and supplier information;
- product prices and available pricing plans;
- shipping prices and delivery estimates;
- destination and option availability;
- converted prices and delivered totals;
- estimated profitability;
- source and freshness information; and
- rankings or labels based on defined comparison criteria.
The Service currently provides no direct checkout. POD Benchmark does not sell, manufacture, print, fulfil, or ship the products shown on the Service.
2. Information may change
Supplier products, prices, discounts, subscriptions, availability, shipping rates, production times, delivery estimates, policies, and other information can change at any time.
Although we aim to present useful and current information, we do not guarantee that information is complete, current, error-free, or available for every product, supplier, configuration, or destination.
A “last checked” or similar date indicates when information was reviewed. It does not guarantee that the information remains current.
Before opening an account, placing an order, quoting a customer, or making a business decision, verify the relevant information directly with the supplier.
3. Prices, shipping, taxes, and currencies
Unless expressly stated otherwise, displayed amounts may not include every cost that applies to your order or business.
Depending on the supplier and transaction, additional costs may include:
- VAT, sales tax, or other taxes;
- customs duties and import charges;
- payment-processing or marketplace fees;
- supplier subscription fees;
- additional-item shipping;
- remote-area or address surcharges;
- design, digitisation, branding, or setup fees; and
- returns, replacements, or customer-support costs.
Currency conversions are estimates. Exchange rates, card-network rates, bank fees, rounding, and supplier checkout calculations may produce a different amount.
Shipping and delivery information is an estimate, not a guaranteed delivery commitment.
4. Profitability estimates
Profitability features are planning tools based on the values and assumptions shown in the Service.
Unless expressly stated otherwise, estimated profit is a before-tax estimate and is not accounting profit. It may exclude tax, refunds, returns, advertising, labour, software, payment processing, marketplace charges, currency conversion, and other business costs.
POD Benchmark does not provide financial, accounting, tax, investment, or legal advice. You are responsible for reviewing the assumptions and obtaining professional advice where appropriate.
We do not guarantee any particular margin, saving, sales result, or business outcome.
5. Comparisons and rankings
Comparisons and rankings are based on the information available to us and the criteria displayed or described by the Service.
A ranking may exclude offers with missing or non-comparable information. It does not represent a universal recommendation or guarantee of product quality, print quality, customer service, fulfilment speed, reliability, or suitability for your business.
POD Benchmark does not claim to have physically tested every product shown.
You remain responsible for ordering samples, reviewing supplier terms, and deciding whether a product or supplier meets your requirements.
6. Third-party suppliers
Your use of a supplier's website, account, products, and services is governed by your agreement with that supplier.
POD Benchmark is not:
- a party to purchases or fulfilment arrangements between you and a supplier;
- an agent, representative, or guarantor of a supplier;
- responsible for supplier accounts, billing, products, production, shipping, intellectual-property checks, customer support, refunds, or disputes; or
- responsible for information, software, or services provided by third parties.
A link to a supplier does not by itself mean that we endorse every product, claim, policy, or practice of that supplier.
Except where expressly stated, POD Benchmark is not owned, operated, sponsored, or endorsed by the suppliers displayed on the Service.
7. Affiliate links and commercial relationships
Some links on the Service are affiliate links.
We may earn a commission if you sign up or purchase through an affiliate link. This does not affect prices or rankings.
Affiliate commissions do not make POD Benchmark a party to your agreement with the supplier.
Any sponsored placement, advertisement, or commercial arrangement that affects how content is presented will be identified where required.
8. Intellectual property
The original text, design, software, branding, graphics, organisation, and presentation of the Service are owned by or licensed to POD Benchmark and are protected by applicable intellectual-property laws.
Supplier names, product names, trademarks, logos, images, and other third-party materials belong to their respective owners. Their appearance on the Service is for identification, information, and comparison purposes and does not transfer ownership to POD Benchmark.
You may use the Service for personal or internal business research and may share ordinary links to public pages.
Without our prior written permission, you may not reproduce, republish, commercially resell, or systematically copy a substantial part of the Service or its organised database, except where applicable law expressly permits it.
9. Acceptable use
You must not:
- use the Service unlawfully or to infringe another person's rights;
- attempt to bypass security, access controls, or technical restrictions;
- introduce malware or harmful code;
- interfere with the Service or impose an unreasonable load on its infrastructure;
- access non-public systems, APIs, or data without permission;
- republish a substantial part of the Service as a competing database or commercial product;
- misrepresent POD Benchmark content or remove disclosures and source context; or
- imply that POD Benchmark or a supplier endorses you without permission.
We may block or restrict access where reasonably necessary to protect the Service, its users, or third parties.
10. Availability and changes
We may add, change, correct, suspend, or remove any part of the Service at any time.
We do not guarantee uninterrupted availability, permanent retention of a particular comparison, or continued support for a product, supplier, destination, currency, or feature.
We are not responsible for interruptions caused by maintenance, provider failures, internet outages, security incidents, or circumstances outside our reasonable control.
11. Disclaimers
The Service is provided on an “as is” and “as available” basis.
To the maximum extent permitted by law, we disclaim implied warranties, including warranties of accuracy, availability, merchantability, fitness for a particular purpose, non-infringement, and satisfactory quality.
Nothing in these Terms limits any warranty or consumer right that applicable law does not allow us to exclude.
12. Limitation of liability
To the maximum extent permitted by law, POD Benchmark and its operators will not be liable for:
- indirect, incidental, special, punitive, or consequential loss;
- lost profit, revenue, sales, savings, opportunity, reputation, or data;
- losses resulting from reliance on incomplete, estimated, or outdated information;
- supplier conduct, products, outages, policies, or contractual disputes; or
- decisions made using comparisons, rankings, calculations, or estimates from the Service.
Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability that cannot legally be excluded.
13. Privacy
Our handling of personal data is described in our Privacy Policy.
Third-party suppliers and affiliate partners apply their own privacy policies when you visit or use their websites.
14. Changes to these Terms
We may update these Terms to reflect changes to the Service, our business, or applicable law.
The effective date at the top identifies the current version. Where reasonably practicable, we will provide notice of material changes through the Service.
Your continued use after updated Terms become effective constitutes acceptance where permitted by law.
15. General
If any provision of these Terms is unenforceable, the remaining provisions continue in effect. A failure to enforce a provision is not a waiver of that provision.
These Terms and the Privacy Policy form the entire agreement between you and POD Benchmark concerning the Service, unless separate written terms expressly apply. Mandatory rights and access to courts available under applicable law are not restricted by these Terms.
16. Contact
Questions about these Terms may be sent to POD Benchmark at privacy@podbenchmark.com.
